Welcome to Viaduct. These Terms & Conditions (“Terms”) govern your use of the Viaduct marketing website (“Website”), mobile application, and related services (“Services”), operated by Viaduct IL Ltd. (“we,” “us,” “our”). By accessing or using the Website or Services, you agree to these Terms. If you do not agree, you must not use Viaduct.

1. Eligibility

  • You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Viaduct app.
  • By using the app, you confirm you have the legal capacity to enter into these Terms.

2. Your Account

  • You are responsible for keeping your login details secure.
  • You must provide accurate and up-to-date information when registering.
  • We may suspend or terminate accounts that violate these Terms.

3. Subscription Plans, Free Trial, Payments, Refunds & Cancellations

  • When you sign up to Viaduct, you will automatically be enrolled in a Viaduct Premium free trial for two (2) weeks.
  • Premium includes: access to Study Metrics, an unlimited number of AI requests using OpenAI's ChatGPT 5/5-mini model (Viaduct Basic users are limited to ChatGPT 3.5 Turbo), unlimited notes, unlimited storage of materials (including files larger than 20KB), and AI-generated personalised study content.
  • After your free trial ends, you may:
    • Continue with Viaduct Premium for £10 per month (pricing may change, with prior notice), or
    • Be automatically downgraded to Viaduct Basic (free), which has limits on the number of notes that may be created, the number and size of materials that may be stored, and does not allow access to Study Metrics or AI-generated personalised study content.
  • Payments for Premium are securely processed by Stripe, Inc. or its affiliates. We do not store your full payment card details.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • Refunds: Payments are non-refundable except where required by law. Any refunds will be processed via Stripe.

4. Use of AI Services

  • Viaduct uses artificial intelligence (“AI”) services from third-party providers (e.g., OpenAI, Anthropic).
  • AI-generated content may contain errors, inaccuracies, or bias. You are responsible for verifying accuracy and suitability.
  • AI outputs must not be relied upon as a substitute for professional advice (medical, legal, financial, etc.).

5. Use of the Website

  • You may use the Website for lawful purposes only.
  • You must not attempt to interfere with its operation, security, or misuse it in any way.

6. Use of Services

  • You agree not to misuse Viaduct, including by engaging in unlawful activity, harassment, spamming, or infringement of others’ rights.
  • We may update, change, or discontinue parts of the Website or Services at any time.

7. Intellectual Property

  • All content, trademarks, and technology in Viaduct are owned by us or our licensors.
  • You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

8. Communications & Marketing

  • By creating an account or signing up for communications, you agree that Viaduct may send you service-related communications.
  • Where permitted by law, you may also receive promotional or marketing emails. You may opt out at any time via the unsubscribe link.

9. Careers & Job Applications

  • If you apply for a role or internship through our Careers section, you confirm your information is accurate.
  • You grant us the right to review, store, and process your application for recruitment purposes.
  • Submitting an application does not guarantee employment.

10. Links to Third-Party Websites

  • The Website may contain links to third-party websites. We are not responsible for their content, security, or practices.

11. Privacy

  • Our Privacy Policy explains how we collect, use, and share your personal data.
  • By using Viaduct, you also agree to our Privacy Policy.

12. Termination

  • You may stop using Viaduct at any time by deleting your account.
  • We may suspend or terminate your access if you breach these Terms or cause harm through your use of Viaduct.

13. Disclaimer of Warranties

  • Viaduct, the Website, and AI-generated outputs are provided “as is” and “as available.”
  • We make no warranties that the Website or Services will always be secure, available, or error-free.

14. Limitation of Liability

  • To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages from your use of Viaduct or reliance on AI-generated content.
  • Our total liability will not exceed the amount you paid to use Viaduct in the 12 months before the claim.

15. Governing Law

  • These Terms are governed by the laws of England and Wales.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to Terms

  • We may update these Terms from time to time.
  • If changes are material, we will notify you (e.g., via email, in-app notice, or Website update).
  • Continued use of Viaduct means you accept the updated Terms.
